Biography

Mr. Buckley is an accomplished forensic economic professional with over 40 years of experience analyzing financial information, business records and third-party data for law firms, government agencies and businesses from Fortune 25 to SMB operating entities. A working practitioner with consulting, academic and C-level operating company experience, Mr. Buckley has designed and executed projects for management and counsel, successfully delivering over four hundred assignments.

Counsel has designated Mr. Buckley to assist with investigations, disputes, and complex litigation in federal court, state court and arbitration. His forensic and expert work includes providing testimony over 120 times in venues from California to Arizona, Florida, Georgia, and Nevada. The following is a small sampling of matters:

  • Designated expert in financial analysis and computation of damages for a publicly traded specialty provider to hospitals throughout the United States. Provided detailed revenue and cost models entailing the analysis and forecasting of multi-year operating scenarios. Attended all sessions and testified for multiple days in a two-month arbitration.
  • Designated expert in financial analysis and damages for a multi-state radiology/imaging business in multiple litigation and valuation assignments. Provided detailed financial modeling and support for owner groups in assessing and litigating various breach claims.
  • Fraud and funds-tracing damages expert leading an investigation of funds movement involving the use of various shell business entities, straw-man accounts, trusts and other measures to conceal and defraud a national financial institution of $12M. Over 40,000 documents reviewed with 500,000 active records developed in datasets detailing funds movement, pertinent transactions, and source/use issues. The analysis covered seven years of activity with preparation of reports and testimony for Federal Court in California and Arizona.
  • Expert forensic economic analysis in a complex funds-tracing project involving the examination of monies moving between various individuals and foreign organizations. Framing the analysis regarding procurement of goods and services in violation of FTO statutes. Detailed inspection involving approximately 300,000 documents and tracing through forty entities and accounts in over ten countries covering a 4-year period. Multiple reports prepared for presentation in Federal Court.
  • Forensic expert developing detailed analysis of all deployment and suppression costs associated with government efforts in containing large wild-land fires. Design, organization and management of supporting cross-functional data including coordinating and cross-reference of all forms of information from federal, state, county, and local agencies as well as private contractors. Projects have included preparation of reports for the presentation of findings in Federal Court. To date over $200M in cost data analyzed for 7-separate fire assignments involving hundreds of thousands of documents and data points.
  • Designed and implemented analysis of performance metrics and business decision points regarding the development, production and sale of media assets such as theatrical films, television shows and music. Analyzed cradle to grave data pertaining to costs and revenues for various media projects across multiple revenue platforms. Specific analysis included production and operating costs, contractual relations, market/industry dynamics and various revenue streams, either actual or potential to support value propositions.
  • Designated forensic economic expert for multiple associated cases providing analysis and assessment of damages in a series of investor related real estate development projects focused on resort, hospitality and golf course development involving the diversion and mismanagement of project funds causing all development programs to fail.
  • Designated expert on damages associated with the misuse of corporate assets in support of a holding-company owned winery and separate wine grape producing properties including an 11-year analysis of operations for all related entities. Analysis of multiple aspects of wine industry performance including grape pricing, distribution, and farming practices. Tracing funds from parent corporate entities through subsidization of subject entity operations.
  • Designated damages expert providing detailed analysis of billing, realization and revenue splits pertaining to performance under a Management Service Agreement within a national provider network. Performance metrics spanning 10-years with millions of data records analyzed. Attended and testified in a multi week arbitration.
  • Designated damages expert in an anti-trust matter involving detailed competitive and market analysis for professional/continuing education in relation to the Bar exam - analysis of products, services and student test preparation and success rates. Project entailed the development of specific examination procedures focusing on distribution, delivery of course material, educational support, market penetration and overall strategy to determine effects of pricing on competitive behavior.

In addition to his forensic practice Mr. Buckley has held senior level management positions at various operating companies including; Chief Financial Officer at Studio Image, Inc., Advisor to the Board of Directors at Glentek, Inc., Director of Financial Planning and Analysis for Pointsource Technologies, Director of Business Development at Gillberg Design and Project Leader/Principal Analyst managing teams of up to 40 professionals on complex matters for the Bank of America Legal Department. Corporate duties included cash flow management, capital budgeting, banking relations, diligence, valuation, and advisement on merger & acquisition activities.

Mr. Buckley received his Master of Business Administration (MBA) from the John E. Anderson Graduate School of Management at UCLA in finance. His master's project focused on analyzing real estate market dynamics in Southern California. Mr. Buckley received his Bachelor of Science from Utah State University in forestry and natural resource management. In addition, Mr. Buckley holds a Master Analyst in Financial Forensics certification from the NACVA (National Association of Certified Valuators and Analysts) and is a current and active member of the organization. He is also a member of the NAFE (National Association of Forensic Economics) and past accredited member of the ASA (American Society of Appraisers) specializing in business valuation.

During his time in Utah Mr. Buckley worked for the USDA Forest Service and was a certified timber cruiser as well as an elite wild-land firefighter (known as a "hot-shot"). Mr. Buckley deployed on approximately one hundred active wild-land fires throughout the western United States.
